LAWINKING REFUND POLICY

Refund Policy 

• The user/s or applicant/s may request for refund on approval of valid email verification.
• The user/s or applicant/s shall disclose valid reasons for making such request for refund of Retainer Fee paid by him.
• The user/s or applicant/s can only make a request for refund of Retainer Fee of Rs 2500/- paid by him for the purposes of verification process.
• The refund amount shall be credited into your source account within 7 working days from the date of issue of refund.
• The user/s or applicant/s shall attach the payment receipt at the time of making such request In order to verify the transaction.
• The user/s or applicant/s shall inform support team via email request prior to the confirmation of email verification or the user may request support alongwith valid reasons for the same, but not after 24 hours from the time of payment.

The user/s or applicant/s shall submit details at the time of initiating a refund request kindly in the below format:

• Duration of Time.
• Reasons for Refund.
• Process for Refund.
• Contact Details.
• Disclosure of Events.

DEFINITIONS

The following capitalized legalterms have the following meanings:

“Client” means any person who entered into a Service Contract to obtain Freelancer Services from a Freelancer.

“Confidential Information” Confidential Information does not include material or information that is known to the public or that: (a) is generally known by third parties as a result of no act or omission of Advocate  or Client; (b) subsequent to disclosure hereunder, was lawfully received without restriction on disclosure from a third party having the right to disseminate the information; (c) was already known by User prior to receiving it from the other party and was not received from a third party in breach of that third party’s obligations of confidentiality; or (d) was independently developed by User without use of another person’s Confidential Information.

“Engagement” means an engagement for Legal Services that an Advocate provides to a Client under a Service Contract on the Site.

“Retainer Fee Instructions” means the Fixed-Price Instructions or the Hourly Expense Payment Agreement with LAWINKING™.

“Fixed-Price Contract” means a Service Contract for which Client is charged a fixed fee agreed between a Client and an Advocate prior to the commencement of a Service Contract, for the completion of all Legal Services contracted by Client for such Service Contract.

“Legal Experts ” means any person who entered into a Legal Service Contract to perform Advocate services for a Client.

“Pro Legal Services ” means requests for specific legal areas of service by pro legal experts required for any other information or materials that a Client receives from a legal expert or for a particular Service Contract.

“Legal Expert Services” means any services performed by a Lawyer, Advocate, Legal Counsel or Representatives herein at LAWINKING™ related to Indian Laws and courts involving skilled legal drafting and legal consultation but not limited to online and legal expert support services in court campuses.

“Advocate Fees” means: (a) for an Hourly Contract, an amount equal to the number of hours recorded by Advocate or Legal Support in any Hourly Invoice, multiplied by the hourly rate set by the Advocate or Legal Support; (b) for a Fixed-Price Contract, the fixed fee agreed between a Client and an Advocate; and (c) any legal expenses or other payments made by a Client.

“Legal Services” means all services performed for or delivered to Clients by Advocates.

“Hourly Contract” means a Service Contract for which Client is charged based on the hourly rate set by the Support.

“Hourly Invoice” means the report of hours recorded for a stated period by an Advocate for the Legal Services performed for a Client.

“Service Contract” means, as applicable, (a) the contractual provisions between a Client and an Advocate governing the Legal Services to be performed by an Advocate for Client for an Engagement; or (b) if you use LAWINKING™, the contractual provisions between Advocate and the Staffing Provider for the provision of services to Client.

“Legal Work” means any work which a lawyer agrees to create for, or actually renders in form of legal consultation to, Client as a result of performing the Legal Services, including, but not limited to, court case filings, law research programs, or other information, or customized legal drafts and any intellectual  legal case theory developed in connection therewith.

Changes to this Refund Policy are effective when they are posted on this page.
