Legal payments are computed as per the specific country government rates applicable on qualification of the Legal Counsels or Advocate(s) dealing with respective client case file. Legal fees and legal costs herein are transparent. Initial part payment against Fixed Retainer Fee is charged & bears no hidden costs.

A retainer fee is payable by the applicant/s or user/s for a sum total of $30 USD for the purposes of verification & commencement of legal services or legal consultation at LAWINKING™.

The retainer is used In a form of compensation for instant use of time involved in re-arranging schedules of an advocate and legal team members to resolve the matter quickly.

The costs incurred to arrange a meeting or as the legal work proceeds, you don’t have to worry about the expenses that arise for arranging the aforementioned legal meetings.

On completion of verification process the client may ask solutions for legal questions or share a concern, submit legal documents or seek any legal work for which a quote will be sent via email on your verified email account depending upon the nature, type, category and availability of the legal expert best suited for the respective legal work or for legal consultation.

If the concerned legal matter is complex, substantial or office time consuming, you pay fee in addition to that of fixed fees as agreed to be payable for legal services.

Advocate(s) are paid in advance or compensated on hours of work or for making themselves available to you for legal work throughout the course of events.

If a client wishes to discuss, Legal Support will discuss the same in the most appropriate way of structuring payment of fees by providing easy simple payment.

• A fixed fee for the case.
• Payment of an agreed hourly rate.
• Payment of a brief fee.

A brief fee pays for preparation of the case for the trial, up to and including the first day of the trial. Then there are separate payments for each additional day of the trial (often referred to as refreshers).

Fees agreed will reflect the experience and seniority of the Advocate whom they relate and all of the circumstances of the case. These can include, but are not limited to :

• The seriousness and complexity of the case.
• The volume of data & preparation required.
• The commitment to prepare the case properly.
• The length of time the trial is expected to take.

The following capitalized legalterms have the following meanings :

“Client” means any person who entered into a Service Contract to obtain Freelancer Services from a Freelancer.

“Confidential Information” Confidential Information does not include material or information that is known to the public or that: (a) is generally known by third parties as a result of no act or omission of Advocate  or Client; (b) subsequent to disclosure hereunder, was lawfully received without restriction on disclosure from a third party having the right to disseminate the information; (c) was already known by User prior to receiving it from the other party and was not received from a third party in breach of that third party’s obligations of confidentiality; or (d) was independently developed by User without use of another person’s Confidential Information.

“Engagement” means an engagement for Legal Services that an Advocate provides to a Client under a Service Contract on the Site.

“Retainer Fee Instructions” means the Fixed-Price Instructions or the Hourly Expense Payment Agreement with LAWINKING™.

“Fixed-Price Contract” means a Service Contract for which Client is charged a fixed fee agreed between a Client and an Advocate prior to the commencement of a Service Contract, for the completion of all Legal Services contracted by Client for such Service Contract.

“Legal Experts ” means any person who entered into a Legal Service Contract to perform Advocate services for a Client.

“Pro Legal Services ” means requests for specific legal areas of service by pro legal experts required for any other information or materials that a Client receives from a legal expert or for a particular Service Contract.

“Legal Expert Services” means any services performed by a Lawyer, Advocate, Legal Counsel or Representatives herein at LAWINKING™ related to Indian Laws and courts involving skilled legal drafting and legal consultation but not limited to online and legal expert support services in court campuses.

“Advocate Fees” means: (a) for an Hourly Contract, an amount equal to the number of hours recorded by Advocate or Legal Support in any Hourly Invoice, multiplied by the hourly rate set by the Advocate or Legal Support; (b) for a Fixed-Price Contract, the fixed fee agreed between a Client and an Advocate; and (c) any legal expenses or other payments made by a Client.

“Legal Services” means all services performed for or delivered to Clients by Advocates.

“Hourly Contract” means a Service Contract for which Client is charged based on the hourly rate set by the Support.

“Hourly Invoice” means the report of hours recorded for a stated period by an Advocate for the Legal Services performed for a Client.

“Service Contract” means, as applicable, (a) the contractual provisions between a Client and an Advocate governing the Legal Services to be performed by an Advocate for Client for an Engagement; or (b) if you use LAWINKING™, the contractual provisions between Advocate and the Staffing Provider for the provision of services to Client.

“Legal Work” means any work which a lawyer agrees to create for, or actually renders in form of legal consultation to, Client as a result of performing the Legal Services, including, but not limited to, court case filings, law research programs, or other information, or customized legal drafts and any intellectual  legal case theory developed in connection therewith.
